*UPDATE*-May 21st, 2023 Motor Vehicle Crash That Resulted in Fatality

On May 20, 2023 at 11:16AM Marshall County Deputies and EMS were dispatched to a motor vehicle crash with injuries between a car and a farm tractor in the 1800 mile of Marsh Avenue (Hwy 330) South of Albion.  Witnesses reported the tractor had been struck and overturned in the ditch. MCSO Deputies arrived on scene and located a tractor upside down in a ditch with rear-end damage and one vehicle with heavy front-end damage still in the roadway.  The driver of the tractor, Clarence Borton, 86, of Albion was pronounced deceased at the scene.  The driver of the other vehicle, Morgan Weiglet, 22, of Albion was transported by Unity Point EMS with non life-threatening injuries.  The Sheriff's Office requested the assistance of the Iowa State Patrol with the crash investigation.  The roadway was closed and traffic re-routed for several hours while a technical investigation was conducted.  The case remained under investigation by the Iowa State Patrol.  

As a result of the technical crash investigation, the driver, Morgan Weigelt, 23, of Albion Iowa was arrested December 5th, 2023 at approximately 5:15PM on Iowa State Patrol arrest warrants. 

Morgan Weigelt was charged with:

Failure to provide proof of financial liability (accident related), simple misdemeanor

Failure to stop in assured and clear distance, simple misdemeanor

Use of an electronic communication device-over the age of 18, simple misdemeanor

Homicide by vehicle, class C felony

Morgan Weigelt is being held in the Marshall County Jail, bond is $10,900.00
